Hernández & Cía. advised Banco BTG Pactual – Cayman Branch in a medium-term financing transaction in favor of Sesuveca del Perú S.A.C.
The financed company is a Peruvian entity engaged in the exploration, exploitation, classification, and commercialization of anthracite coal in Salaverry, Trujillo, La Libertad region since 2002. Additionally, it operates a facility in Paracas, Ica region, where it carries out iron crushing and classification activities.
The financing was granted for the total amount of US$ 6.600 000 million, intended to cover investments and capital expenditures of the financed company, as well as to restructure its existing financial obligations. As collateral for this financing transaction, the company has incorporated a trust over assets comprising six (6) of its properties, located in the district of Salaverry, Trujillo.
For this transaction, a thorough due diligence process was conducted on the legal status of the company, its operations, and the properties subject to the collateral. This comprehensive review included verification of environmental, operational, and sectoral permits, as well as compliance with legal and regulatory obligations in connection with the company’s operations and ongoing administrative proceedings.
