We offer advice on free competition, unfair competition, advertising, consumer protection, and market access. We cover both preventive aspects —including information and permanent analysis of the regulatory framework—and the resolution of conflicts and the handling of administrative procedures before the National Institute for the Defense of Competition and Intellectual Property (Indecopi) and related judicial processes.
In free competition, we cover collusive practices, agreements between competitors, anticompetitive conduct, abuse of a dominant position, antitrust regulation, concentration control, horizontal restrictions, resale price fixing, tied sales, exclusivity agreements, vertical agreements, policies with consumers. Essential facilities, commercial contracting (distribution, supply, association), unjustified refusals of contracting, tied sales, implementation of strategic barriers to entry, predatory prices, and other monopolistic practices.
In unfair competition and advertising, we address issues such as commercial strategy and contracting, advertising plan, copy advice, sectorial regulatory compliance, labeling, unfair practices, acts of deception, confusion, imitation, denigration or exploitation of the reputation of others, publicity rights, acts of obstruction, unregistered trademarks, among others.
We offer advice on free competition, unfair competition, advertising, consumer protection, and market access. In addition, we cover both preventive aspects —including information and permanent analysis of the regulatory framework—and the resolution of conflicts and the handling of administrative procedures before the National Institute for the Defense of Competition and Intellectual Property (Indecopi) and related judicial processes.
In access to the market, we identify acts and provisions of the public administration (demands, requirements, prohibitions, or charges) aimed at conditioning, restricting, or hindering the access and permanence of economic agents in the market. Also, acts that unduly affect those administered in the processing of administrative procedures and that, therefore, constitute illegal and/or irrational bureaucratic barriers. We advise companies and unions on eliminating these barriers through the respective complaints and procedures before Indecopi.
