The exercise of constitutional law has acquired a growing relevance to protect the activities of both natural persons and legal entities since the foundations of the Peruvian legal system are contained in the Political Constitution. Therefore, the application of constitutional law is becoming more and more widespread in order to achieve effective protection mechanisms, beyond those included in other disciplines and special legislation.
Hernández & Cía. has a leading team in constitutional litigation, specialized in the design of strategies for the protection of fundamental rights and the sponsorship of our clients in constitutional proceedings (amparo, habeas corpus, habeas data, unconstitutionality, popular, compliance and competition). We also participate by providing constitutional grounds and support for the structure and functioning of the State in administrative proceedings and judicial processes in different matters involving the defense of fundamental rights.
Additionally, we render preventive advice to public and private entities on constitutional and public law issues that have a material impact on economic activities and civil liberties.
Our lawyers are considered opinion leaders in constitutional matters and some of them have collaborated in the commissions that were constituted for the reform of the Constitution and in the elaboration of the Preliminary Draft of the Constitutional Procedural Code, currently in force.
