Projects, Infrastructure & Construction

At Hernández & Cía., we have extensive experience advising our clients on infrastructure development projects financed through private, public, and public-private structures.

On the one hand, we actively participate in projects developed under self-sustaining and co-financed Public-Private Partnerships (PPPs), with particular emphasis on road, port, and airport transport infrastructure, as well as energy transmission, telecommunications, healthcare, and education projects.

We also continuously advise clients throughout the various stages of the award and execution of traditional public works or those carried out under special schemes such as Government-to-Government (G2G) contracts, Works for Taxes (OxI), or under regimes subject to the rules and principles of multilateral organizations such as the World Bank, IDB, CAF, KfW, JICA, among others.

In private projects, our practice has focused on the development of mining infrastructure, power generation projects, and urban developments such as shopping centers, schools, clinics, and large-scale housing projects.

We provide ongoing and intensive advisory services during the project execution (CAPEX) stage. This begins with the drafting and negotiation of construction; engineering and construction; EPC and turnkey; and construction management contracts. It then extends to legal advisory services in contract administration, in close coordination with the technical and financial management of the works, in order to properly manage risks related to delays, disruptions, cost overruns, and other contingencies. Our experience has shown that preventive work in construction project management is decisive in achieving success within reasonable cost and schedule parameters.

Our services also include consulting on the corporate, regulatory, financial, and tax planning and structuring of projects in all their forms. Our work encompasses due diligence processes, bankability analyses, and the structuring and negotiation of all agreements necessary to make financing viable, as well as the corresponding security arrangements.

Finally, we have widely recognized experience in construction and infrastructure dispute resolution, whether through dispute boards or arbitration. Several members of our Projects, Infrastructure, and Construction practice have been recognized as leaders in construction dispute resolution.

In addition, we advise our clients on matters relating to access to and use of public-use infrastructure across various sectors, whether as infrastructure owners or as intermediate or end users.
